Legal Disclaimer
1. Scope
This legal disclaimer applies to the use of the online portal of Property Manager (the “Operator”). By signing in to the portal, you accept the following terms.
2. Accuracy of information
The Operator provides the content and documents in the portal with the greatest care. However, the Operator gives no warranty and accepts no liability for the accuracy, completeness or timeliness of the information and documents provided. The original documents and the Operator’s written communications are authoritative. Please report incorrect or missing information to the Operator without delay.
3. Availability of the service
There is no entitlement to uninterrupted or error-free availability of the portal. Maintenance, technical faults, attacks by third parties or outages of network and hosting providers may temporarily restrict or prevent its use. The Operator is not liable for any damage resulting from the unavailability of the service, from delays or from the loss of data. We recommend that you also save important documents locally.
4. Login credentials and duty of care
You are responsible for managing your login credentials (e-mail address, password and two-factor authentication factors) properly and securely. In particular, you undertake to:
- choose a strong password that you use only for this portal, and keep it secret;
- not disclose your credentials to third parties or store them unprotected;
- protect your devices (computer, smartphone) with current updates and a screen lock;
- change your password immediately and inform the Operator if you suspect misuse.
The Operator accepts no liability for any damage that arises because login credentials were not managed properly and securely.
5. Two-factor authentication (MFA)
The Operator strongly recommends enabling two-factor authentication in the portal. Users who do not enable two-factor authentication bear the full risk of access by unauthorised third parties themselves. In this case, the Operator accepts no liability whatsoever for access by unauthorised third parties or its consequences.
6. Limitation of liability
Any liability of the Operator for direct or indirect damage in connection with the use of the portal is excluded to the extent permitted by law. Mandatory liability for unlawful intent and gross negligence (Art. 100 of the Swiss Code of Obligations) remains reserved.
7. Downloaded files
You are responsible for storing and further using downloaded documents. Documents are confidential and may only be used within the scope of the tenancy or management relationship.
8. Data protection
Information on how your personal data is processed can be found in the Operator’s privacy policy [link to privacy policy].
9. Governing law and place of jurisdiction
Swiss law applies exclusively. The place of jurisdiction is [registered office of the Operator], unless mandatory statutory provisions provide otherwise.
